The data controller is the person, in this case Solinest , who determines the methods and purposes of the processing of personal data. As the name suggests, the data controller assumes responsibility for the personal data processing they implement and is the User's main point of contact for exercising their rights regarding this processing.

Categories of personal data

Collection of personal data : Solinest collects and processes your personal data in the context of (i) your registration on the Site, (ii) your use of the various functionalities of the Site, (iii) when you order products from the Site (iv) and more generally when you contact or request information from Solinest concerning the Site or an order of products placed from it.

The personal data we collect is provided voluntarily by Users, for example, when creating an account, placing an order on the Site, or sending a message via the Site's "Contact" form. Your data may also be transmitted to us by authorized third parties, including our advertising and communication agencies. Personal data may also be transmitted to us by social networks such as Facebook and Instagram, as well as by shipping companies (such as the postal service).

Personal data concerned This personal data includes, in particular:

Communication of personal data

The personal data collected and processed may be transmitted:

to authorized persons of the relevant departments within Solinest (for example, the marketing department for statistical data, logistics departments for orders, customer services for your questions…).

to the companies of the Solinest group

to service providers or subcontractors that Solinest uses to achieve the purposes set out in Article 4.

for deliveries of products abroad, to customs services,

where appropriate, to administrative and judicial authorities in compliance with our legal obligations or to enable us to defend our rights and interests.

Children

For processing carried out on the basis of consent, and when the User is a minor under 15 years of age, Solinest requires the joint consent of said minor and the holder(s) of parental responsibility. In this case, and upon consenting to the processing, the minor under 15 years of age and the parental responsibility holder(s) undertake to send Solinest their written consent to the contact details above.

Security personal data

Solinest implements organizational, technical, software, and physical digital security measures to protect personal data against loss, unauthorized access, disclosure, or alteration. Furthermore, Solinest staff are bound by confidentiality agreements regarding your data.

The Site is fully secured using https format, which allows for the encryption of data transmitted between your device and the Site.

To pay for your order by credit card, you will be redirected to a secure page managed by our partner bank. Solinest does not collect your payment details: all your bank details are collected solely by our payment service provider, thus guaranteeing payment security.

 

Data retention

Solinest retains your personal data for the time necessary to fulfill the purposes for which it was collected, plus any applicable legal retention periods for archiving, data retention, and statutes of limitations (generally five years following the end of the contractual relationship). Once processing is complete, personal data will either be deleted or anonymized by Solinest. For prospective clients, data is deleted three years after our last contact.

For example:

Your user account data is kept for the entire duration of your membership.
Order data may be kept for 10 years for accounting purposes, or where applicable for the entire duration of a dispute and until all avenues of appeal have been exhausted.

User Rights

Users are informed that they have, under the conditions of the law, a right of access, rectification, erasure and portability of their personal data, as well as a right to limit and to object to the processing of this data.

Users also have the right to organize the fate of their personal data in the event of death, as well as the right to lodge a complaint with the CNIL, whose website is accessible at the following address http://www.cnil.fr and whose headquarters are located at 3 Place de Fontenoy, 75007 Paris.

For processing based on consent, the User may withdraw it at any time, without affecting the lawfulness of the processing prior to this withdrawal.

Right of access: The User has the right to obtain from Solinest confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and information relating to the purposes of the processing (Art. 15 of Regulation 2016/679 on the protection of personal data (“ GDPR ")). Clearly unfounded, excessive or repetitive requests are likely to go unanswered.

Right of rectification The User has the right to obtain from Solinest, as soon as possible, the rectification of his personal data which he considers inaccurate (Art. 16 of the GDPR),

Right to erasure The User has the right to obtain from Solinest the erasure of their personal data, under the conditions set out in Article 17 of the GDPR.

Right to data portability: The User has the right to receive the personal data concerning him or her that he or she has provided to Solinest, in a structured, commonly used and machine-readable format (Article 20 of the GDPR). This right applies only to data provided where the processing is based on consent or on a contract and is carried out by automated means.

Right to restriction of processing The User may obtain from Solinest the restriction of the processing of their personal data under the conditions of Article 18 of the GDPR.

Right to withdraw consent Users have the right to withdraw their consent to the processing of their data if that processing is based on consent. The withdrawal of this consent does not affect the lawfulness of the processing based on consent before its withdrawal.

Right to object: The User has the right to object at any time, on grounds relating to his or her particular situation, to the processing of his or her personal data, where such processing is based on legitimate interest and under the conditions of Article 21 of the GDPR.

Right to determine the fate of one's personal data in the event of death : The User may define general or specific instructions relating to the retention, erasure and communication of his personal data after his death (law 78-17 of 6 January 1978 as amended, art. 40, II),

Right to lodge a complaint with a supervisory authority Without prejudice to any other administrative or judicial remedy, the User has the right to lodge a complaint with a supervisory authority if he considers that the processing of personal data relating to him constitutes a violation of the regulations applicable to personal data (Art. 77 of the GDPR).

2. Application of Terms and Conditions : These general terms and conditions of sale (the " Terms and Conditions ") apply to all orders for Products (defined below in Article 3 of the Terms and Conditions) placed on the online store https://joyfuel-nutrition.com (hereinafter the " Website ") with the company Solinest, whose contact details are provided in the footer (" Solinest "), by a consumer, i.e., a natural person of legal age not acting for professional or commercial purposes (the " Customer "). As this is a B2C website and not a B2B website, the invoice is therefore inclusive of all taxes.

The General Terms and Conditions specify in particular the conditions of ordering, payment, delivery and handling of any returns of Products ordered by Customers.

These General Terms and Conditions apply to the exclusion of all other conditions, including those applicable to sales in stores or through other distribution and marketing channels. They prevail, where applicable, over any other conflicting document issued by the Customer.

3. Products :

3.1 Product Characteristics : The products are Joyfuel brand food products, including protein bars (the " Products "). Detailed descriptions of the Products are provided by Solinest on the Website to allow the Customer to understand the main characteristics of the Products before placing a final order. The Customer acknowledges having read, before placing any order, the description of each Product ordered and the specific ordering conditions mentioned on the Website (name, price, ingredients, weight, quantity, color, specific features of the Products, and where applicable, dimensions, size, and limitations of certain Products).

The photographs used to present the Products accurately reproduce the Products offered to the buyer, but minor variations in the representation of said Products do not engage the responsibility of Solinest and do not affect the validity of the sale.
Photographs and illustrations other than of Products, presented on the Site are not contractual and cannot engage the liability of Solinest.

For any other information or questions, our Customer Relations Service will be accessible according to the terms specified in article 19 below, the choice and purchase of the Product remaining in all cases under the responsibility of the Customer.

3.2 Availability of ordered Products : Product offers are subject to available stock, as specified when placing the order.

Solinest makes every effort to fulfill the Customer's order. In the event that Products are unavailable after the order has been registered, the Customer will be informed by email by Joyfuel Customer Service as soon as possible and will be offered either a Product exchange or a refund of the price of the Products within fourteen (14) calendar days from the date of placing and payment of the order.

4. Prices : The prices displayed on the Site are in euros, inclusive of all taxes, based on the VAT rate in force in France. Any order delivered outside mainland France may be subject to local taxes, customs duties, port taxes, and customs clearance fees upon delivery, as well as bank charges. Payment of these charges is the responsibility of the Customer.

Delivery charges depend on the order amount and the delivery location. The amount of these charges is shown to the customer during the order completion process in the " Your Order " section.

Solinest reserves the right to modify the prices of its Products at any time. However, the price of the Products cannot be modified after the Order has been validated. The price applicable to the Customer's order is the price in effect at the time the Customer validates their order by clicking on the " Order with obligation to pay " tab, plus delivery charges calculated based on the information entered by the Customer and displayed before the Order is finalized, as well as VAT.

5. Customer Account :

5.1 Account Creation Conditions : Before or at the same time as placing an order on the Site, the Customer may create a customer account (the " Customer Account ") by completing the form available for this purpose on the Site and checking the box relating to acceptance of the Terms and Conditions; otherwise, the Customer Account cannot be created. The Customer Account details, in particular, the Customer's contact information, order history, and available discount vouchers.

The creation of any new Customer Account will be confirmed by an automated email from Solinest containing, among other things, the contact details for its customer service department. In this regard, the Customer guarantees that the data provided is accurate and complete and agrees to confirm, by any appropriate means and upon Solinest's first request, their identity and the information provided.

5.2 User ID Management :

The Client is solely responsible for choosing their username and password (the " Credentials "), particularly with regard to third-party rights (identity theft or intellectual property rights), as well as maintaining their confidentiality and preventing any fraudulent or unauthorized use by third parties. Solinest is not obligated to verify the identity of each Client and cannot be held liable in the event of fraudulent use of their Credentials or payment methods.

In case of loss or forgetting of the password, the Client may send Solinest a request to reset their password.

6. Order :

6.1 Placing an order : The Customer can only place orders for Products on the Site; no orders can be placed by email, fax, mail or telephone.

This is a binding order, meaning that placing the order implies immediate payment by the Customer. The minimum order amount is twenty (20) euros.

To place an order, the Customer chooses a Product, its color and size if applicable, the desired quantity, and adds it to their cart by clicking the " Add to cart " button, without being obligated to purchase. The " Cart " page that appears summarizes the desired order (Product, quantity, Product price and total price including VAT, delivery times and costs), and the Customer can continue the order by clicking the " Place order " button, and read and explicitly accept the Terms and Conditions of Sale by clicking the " I have read and agree to the Terms and Conditions of Sale " button, it being noted that the Terms and Conditions of Sale are accessible from all pages of the Site;


On the " Shopping Cart " page, the order is summarized with the same information, and the Customer can:

– remove the selected Products from your basket at any time by clicking on “ Remove ”;

– identify and correct any errors made when selecting Products on the Site,

– change the desired quantity of Products by modifying the number entered to display the corrected total price including VAT of the order.

At any time, the Customer can view a summary of their order by clicking on the " Shopping Cart " page.

On the " Billing " page, the Customer can enter a discount code if they have one.

To finalize the order process, the Customer must successively:

  • (i) If the Customer does not have a customer account, they must provide their information (surname, first name, email address or mobile phone number, delivery address); (ii) If the Customer has a Customer Account, the delivery details will be those associated with the Customer Account, unless otherwise specified by the Customer. The Customer also chooses their delivery method, it being understood that the applicable delivery charges are borne by the Customer for all orders under fifty (50) euros in France;
  • Choose the payment method: “ Payment by Bank Card ” or “ Apple Pay ” and enter the payment information to finalize the order and pay for your order by clicking on the “ Check Order ” button.

Orders placed on the Site are automatically cancelled if full payment is not received. Order registration is confirmed by sending an automated email to the email address associated with the Customer Account or the address provided during express checkout, after payment has been received. The Customer will be informed of the order status only by email.

 

6.2 Sales Contract : The sale will only be considered final and ownership of the Products will only transfer to the Customer after validation and payment by the Customer in accordance with the instructions on the Website and after the Customer has received the order confirmation email. The invoice will be sent to the Customer within 2 days of placing the order.

The order confirmation email will summarize the essential details of the order (quantity, packaging, contents, maximum delivery date, amount, shipping address, etc.). It is the Customer's responsibility to verify the accuracy of the order and to report any errors immediately. For any order cancellation request before shipment, the Customer must contact Solinest's Customer Service department using the contact information provided in Article 19 of the Terms and Conditions and reiterated in the confirmation email, upon receipt of this email.

If the order concerns perishable items and is already being shipped, Solinest reserves the right to refuse cancellation or modification of an order, subject to the cases provided for in Article 19 below.

In accordance with Article L.213-1 of the French Consumer Code, when a sale involves an amount equal to or greater than €120 including VAT, Solinest retains the contractual documents for 10 years and guarantees access to them to the Customer, who may consult them upon simple request by email: hello@joyfuel-nutrition.com. Solinest's computerized records will be considered by the parties as proof of communications, orders, payments, and transactions between them.

6.3 Technical Specifications : The Client acknowledges that they possess the necessary resources and skills to use the Site. The equipment, including computer equipment, required to access and use the Site, as well as any related telecommunications costs, are the sole responsibility of the Client.

Solinest cannot be held liable for any alleged or actual damage, suffered directly or indirectly, by any Client following their connection to the Site, the consultation and/or use of the information provided on the Site or following the temporary impossibility of accessing the Site for technical maintenance or update reasons.

  • 6.4 Payment : The price is due in full upon confirmation of the order by the Customer. Payment for purchases made on the Site can be made by credit card from the Carte Bleue, Visa, or MasterCard network, or by Apple Pay.

It is specified that the Site has an online payment security system (“SSL protocol”), via an external platform managed by a payment provider Shopify International Limited - 1-2 Victoria Buildings, Haddington Road - Dublin 4 - D04 XN32 IRELAND , which guarantees the confidentiality of bank details and compliance with PCI DSS security standards.

Ownership of the Products will only transfer to the Customer after payment has been duly made and confirmed by Solinest.

 

  • 7. Deliveries : Deliveries can be made exclusively to the following countries: Metropolitan France, including Corsica.

Delivery is made according to the delivery method chosen by the Customer when placing their order on the Website, and is made to the delivery address specified during the order process (which may differ from the billing address). The estimated delivery time and costs are indicated on the order summary before the Customer confirms the order, and the cost amount depends on the order details (quantity ordered, delivery location, delivery speed, etc.). Delivery is considered complete upon the transfer of physical possession or control of the Product to the Customer. Unless otherwise specified or in the event of unavailability of one or more Products, the ordered Products will be delivered in a single shipment.

If the ordered Products have not been delivered within thirty days of the conclusion of the sales contract, for any reason other than force majeure, the sale may be cancelled at the Customer's written request under the conditions set forth in Articles L 216-1 et seq. of the French Consumer Code. The sums paid by the Customer will then be refunded no later than fourteen days following the date of cancellation of the contract, without any compensation or deductions.

The risk of loss or damage to the ordered product(s) is transferred to the Customer upon physical delivery, unless delivery is entrusted to a carrier other than those offered by Solinest. The Customer is required to check the condition of the delivered products and to send an email to hello@joyfuel-nutrition.com within 72 hours to inform Solinest of any damage. If the package is damaged or has been opened, the Customer is advised to refuse delivery or to note specific and detailed reservations on the delivery slip and reiterate these reservations by registered mail to the carrier within three (3) days of receiving the package.

The Customer then has eight days from delivery to submit, by registered letter with acknowledgment of receipt, any reservations or claims regarding non-conformity or apparent defects in the delivered products, along with all supporting documentation (including photographs). After this period, and if these formalities have not been observed, the Products will be deemed compliant and free from any apparent defects, and no claim will be validly accepted by Solinest. For reasons of hygiene and food safety, perishable goods will not be returned or exchanged. However, Solinest will reimburse or replace, within 14 days and at its own expense, any delivered products whose apparent or hidden defects or non-conformity have been duly proven by the Customer, under the conditions stipulated in Articles L 217-3 et seq. of the French Consumer Code and those set forth in these General Terms and Conditions of Sale.

In any event, the Customer can contact Solinest using the contact details in article 18 of the General Terms and Conditions.

In the event that a package regularly transported to the Customer is returned to Solinest, the Customer will be notified and the costs of a new shipment will be charged to the Customer according to the applicable rates.

  • 8. Refusal to Process an Order : Solinest reserves the right to withdraw any Product offered for sale on the Site at any time and to modify or replace any information appearing on the Site. Despite Solinest's efforts to fulfill all orders, exceptional circumstances may arise (for example, manufacturing or stock issues, or a payment incident) and force Solinest, at any time, to refuse to process an order, even if it has previously been confirmed. If payment has already been made, Solinest will reimburse the Customer, as soon as possible, the full price paid, including delivery charges. Cancellation of the order will not incur any charges for the Customer.

Solinest shall not be liable to the Customer or any third party for the withdrawal of a Product from the Site, the modification or removal of information appearing on the Site or the cancellation of an order in the circumstances referred to in this article 9, which would occur after confirmation of the order by Solinest.


  • 9. Right of Withdrawal and Returns :

9.1 General principle :

In accordance with the Consumer Code, the Customer has the right, without having to justify themselves or pay any penalty, to exercise their right of withdrawal from the Products ordered on the Site within fourteen (14) calendar days from the day of receipt of the Product(s) (the date appearing on the carrier's receipt being proof), by returning the form attached to these Terms and Conditions, duly completed, either:

  • – by email to the following address: hello@joyfuel-nutrition.com.

After exercising his right of withdrawal, the Customer must return the new Product(s) in their original packaging and, for clothing Products, unworn and unwashed, no later than fourteen (14) days following the date of sending his letter or email of withdrawal.

The return shipping costs for the Product(s) remain entirely at the customer's expense.

Clothing products returned incomplete, damaged, worn or soiled will not be accepted by Solinest.

Solinest undertakes to reimburse the Customer for the price of returned Products by crediting the bank card used for payment, within a maximum of fourteen (14) days following the date of receipt of their withdrawal notice. If the right of withdrawal was exercised before Solinest shipped the goods, any standard delivery charges paid by the Customer will also be refunded. Only the standard delivery charges incurred by the Customer will be reimbursed by Solinest, excluding any additional charges resulting from the Customer's choice of a more expensive delivery method.

9.2 Legal Exceptions : In accordance with legal provisions and in particular Articles L221-28-3°, 4° and 5° of the Consumer Code, the Customer's right of withdrawal is not applicable in the following cases: (i) Products manufactured according to the Customer's specifications or clearly personalized; (ii) Products liable to deteriorate or expire rapidly, as identified by Solinest in the description of the Products; (iii) Products which have been unsealed by the Customer after delivery and which cannot be returned for reasons of hygiene or health protection.

  • 10. Legal guarantees : Solinest is liable for defects in conformity of the Products, under the conditions of Articles L. 217-3 et seq., and L. 217-8 et seq. of the Consumer Code, and for hidden defects in the thing sold, under the conditions of Articles 1641 et seq. of the Civil Code.

 

10.1 Legal guarantee of conformity:

When the Customer acts under the legal guarantee of conformity, he/she:

– has a period of two years from the delivery of the goods to take action;

– may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L. 217-8 of the Consumer Code;

– is exempt from providing proof of the existence of the non-conformity of the goods during the twenty-four months following delivery of the goods.

10.2 Legal guarantee against hidden defects on products sold:

The Customer may invoke the legal guarantee against hidden defects in the goods sold (Article 1641 of the Civil Code). In this case, you may choose between rescinding the sale or obtaining a reduction in the sale price (Article 1644 of the Civil Code). This action must be brought by the buyer within two years of discovering the defect (Article 1648 of the Civil Code).



  • 11. Force Majeure : Solinest's obligations will be suspended in the event of force majeure for as long as the circumstances giving rise to such force majeure event persist. Force majeure is understood in the sense traditionally recognized by French case law.

  • 12. Intellectual Property : The use of the Site or the ordering of a product does not, under any circumstances, grant the Customer any rights to the trademarks, logos or any distinctive signs relating to the Products and the Site.

13. Personal Data : Solinest processes personal data when you use the Site, register on the Site, and order Products on the Site. The details of this processing and your rights regarding it are set out in Solinest's " Personal Data Protection Policy, " which can be consulted at any time on the Site at https://joyfuel-nutrition.com/pages/politique-de-confidentialite

14. Mediation : In accordance with Articles L. 612-1 et seq. of the French Consumer Code, Solinest subscribes to the mediation services of the CMAP, whose contact details are 39 avenue Franklin D. Roosevelt, 75008 Paris, France. In the event of a dispute, the Customer must send Solinest a written complaint by registered mail with return receipt requested, seeking to resolve the dispute. If no agreement is reached, the Customer may contact the CMAP free of charge, under the conditions specified on its website: https://www.cmap.fr/consommateurs/


  • Furthermore, the Customer may also file a complaint on the online dispute resolution platform provided by the European Commission, accessible at https://ec.europa.eu/consumers/odr . Solinest is a member of the CMAP.

 

15. Partial invalidity : if one or more provisions of the General Terms and Conditions were deemed unlawful or void, this unlawfulness or voidness shall not render unlawful or void the other provisions of the General Terms and Conditions, which shall remain applicable.

16. Applicable law : The General Terms and Conditions and the relationship between the Client and Solinest are governed by French law, excluding conflict of law rules, subject to the application of mandatory provisions of the law of the State where the Client has his habitual residence if this is located in the territory of the European Union.

17. Jurisdiction : In the absence of an amicable agreement, the competent court shall be, at the plaintiff's choice and in accordance with legal provisions, either that of the defendant's domicile or that of the place of actual delivery of the Products.
